Duty-free retailer contesting its exclusion from tender proceedings

As reported previously in RavenFox.com, Flemingo applied for an injunction against BIAL, unsuccessfully seeking a postponement to its duty-free retail tender. The retailer claimed that its joint venture with Aer Rianta International was unfairly prevented from qualifying for the tender, eventually won by The Nuance Group and Shoppers Stop.
A division bench allowed Flemingo to amend the writ petition and noted that the Supreme Court has been too in suggesting the petition should be dismissed. The case is adjourned until September 18 2007.
