Flemingo case against Bangalore airport continues

Duty-free retailer contesting its exclusion from tender proceedings

Flemingo Duty Free Shops has got permission from the Karnataka High Court to amend its writ petition contesting the company’s exclusion from Bangalore International airport’s (BIAL) tender proceedings to select new retail concessions. Flemingo claims BIAL had not allowed it to participate in the bid to establish duty-free shops at the new international airport at Devanahalli, near Bangalore, even though it had sent its expression of interest.

 

As reported previously in RavenFox.com, Flemingo applied for an injunction against BIAL, unsuccessfully seeking a postponement to its duty-free retail tender. The retailer claimed that its joint venture with Aer Rianta International was unfairly prevented from qualifying for the tender, eventually won by The Nuance Group and Shopper’s Stop.

 

A division bench allowed Flemingo to amend the writ petition and noted that the Supreme Court has been too in suggesting the petition should be dismissed. The case is adjourned until September 18 2007.
